Arbitration & Class Action Waiver

Any controversy or claim arising out of or related to the use of the Website that cannot be resolved through an informal process or through negotiation within 120 days shall be settled by binding arbitration administered by the American Arbitration Association, and judgment on the award rendered may be entered in any court having jurisdiction thereof. The arbitration will be conducted in the COUNTY OF DAVIDSON but may proceed telephonically (if the claimant so chooses).

You agree that disputes will only be arbitrated on an individual basis and shall not be consolidated, on a class wide, representative basis, or with any other arbitration(s) or other proceedings that involve any claim or controversy of any other party. If for any reason this arbitration clause is unenforceable or inapplicable, both you and we agree, to the extent permissible by law, to waive any right to pursue any claims on a class action basis. If any portion of this class action waiver is limited, void, or unenforceable, then our agreement to arbitrate under this section will not apply and any controversy or claim must be brought exclusively in the state and federal courts in Tennessee.

This Agreement may be terminated by Youutekk without notice at any time for any reason and may be terminated by you upon notice to Youutekk at any time for any reason. The provisions of paragraphs 3 (Copyright, License, Use Restrictions, and Idea Submission), 5 (Indemnification), 6 (Third Party Rights) and 8 (Miscellaneous) shall survive any termination of this Agreement.

Miscellaneous. This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. You agree that any legal action or proceeding between youutekk and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Davidson County, Tennessee. You hereby waive your right to a jury trial in any action with respect to the subject matter of this Agreement. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises. youutekk’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Youutekk may assign its rights and duties under this Agreement to any party at any time without notice to you.

youutekk’s main supplement suppliers are Life Extension and Kalyagen.  Their brands’ trademarks as indicated on the website are owned by the respective companies. Other trademarks and service marks appearing on the Service may be owned by youutekk or by other parties including third parties not affiliated with youutekk.

Notice. youutekk may deliver notice to you under this Agreement by means of electronic mail, a general notice on the Service, or by written communication delivered by first class U.S. mail to your address on record in youutekk’s account information.
